These Terms of Service govern your access to and use of Cyberkov W.L.L.'s website and services, in accordance with the laws of the State of Kuwait. Please read these terms carefully before using our services. By accessing or using our services, you agree to be bound by these terms.

Acceptance of Terms

Agreement to Terms

By accessing or using Cyberkov W.L.L.'s website, services, or any associated platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in accordance with the laws of the State of Kuwait, including the Electronic Transactions Law (Law No 20 of 2014) and the Kuwait Civil Code (Decree Law No 67 of 1980). If you do not agree to these terms, you must not access or use our services.

Eligibility

You must be at least 21 years of age (the age of legal capacity under Article 109 of the Kuwait Civil Code) or have the authorization of your legal guardian to enter into binding contracts to use our services. By using our services, you represent and warrant that you meet these eligibility requirements under Kuwaiti law.

Modifications

Cyberkov W.L.L. reserves the right to modify these Terms of Service at any time. In accordance with Article 4 of the E-Transactions Law, we will notify users of material changes by posting the updated terms on our website. Your continued use of our services after such modifications constitutes acceptance of the updated terms through affirmative conduct indicating approval.

Description of Services

Cybersecurity Services

Cyberkov provides comprehensive cybersecurity services including but not limited to: Security Operations Center (SOC+), Managed Detection and Response (MDR+), Vulnerability Management (VMS+), Insider Threat Monitoring (ITM+), Human Risk Management (HRM+), and various professional security services.

Signal Security Services

Our signal security offerings include Counter-Espionage Services (CES+), Technical Surveillance Countermeasures (TSCM), Executive Protection Services (EPS+), and Secure Speech Solutions (SSES) designed to protect against electronic surveillance and eavesdropping threats.

Service Availability

While we strive to maintain continuous service availability, Cyberkov does not guarantee uninterrupted access to our services. Scheduled maintenance, system updates, or unforeseen circumstances may temporarily affect service availability.

User Obligations

Accurate Information

You agree to provide accurate, current, and complete information when using our services or contacting us. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

Lawful Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You shall not use our services to engage in any activity that violates applicable laws, regulations, or third-party rights.

Cooperation

For security services to be effective, you agree to cooperate with Cyberkov by providing necessary access, information, and resources as reasonably required for service delivery. Failure to cooperate may impact service effectiveness.

Prohibited Activities

Unauthorized Access

You shall not attempt to gain unauthorized access to any portion of our services, systems, or networks. Under the Kuwait Cybercrime Law (Law No 63 of 2015), unauthorized access to information systems is a criminal offense punishable by imprisonment and fines. This includes attempting to probe, scan, or test the vulnerability of our systems without explicit written authorization.

Interference

You shall not interfere with or disrupt the integrity or performance of our services, or attempt to do so through any means including denial-of-service attacks, malware distribution, or other malicious activities. Such actions constitute criminal offenses under Articles 2-4 of the Kuwait Cybercrime Law and are subject to prosecution.

Misrepresentation

You shall not impersonate Cyberkov W.L.L., its employees, or other users, or falsely state or otherwise misrepresent your affiliation with any person or entity. Identity fraud and misrepresentation are punishable offenses under Kuwaiti law, including the Cybercrime Law and the Kuwait Penal Code.

Intellectual Property

Ownership

All content, trademarks, service marks, logos, and intellectual property displayed on our website and used in our services are the property of Cyberkov W.L.L. or its licensors, protected under Kuwait's Industrial Property Law (Law No 68 of 1980) and the Copyright Law (Law No 64 of 1999, as amended by Law No 22 of 2016). Nothing in these Terms grants you any right to use our intellectual property without prior written consent.

License

Subject to these Terms, Cyberkov grants you a limited, non-exclusive, non-transferable license to access and use our website for its intended purposes. This license does not include the right to modify, copy, distribute, or create derivative works.

Feedback

Any feedback, suggestions, or ideas you provide regarding our services may be used by Cyberkov without any obligation to compensate you. By submitting feedback, you grant us a perpetual, irrevocable license to use such feedback.

Confidentiality

Client Information

Cyberkov treats all client information with the highest level of confidentiality. We implement strict security measures to protect sensitive information obtained during the course of providing our services.

Non-Disclosure

Our personnel are bound by confidentiality agreements and are prohibited from disclosing client information to unauthorized parties. This obligation survives the termination of any service agreement.

Exceptions

Confidentiality obligations do not apply to information that is publicly available, independently developed, rightfully received from third parties, or required to be disclosed by law or court order.

Limitation of Liability

Disclaimer of Warranties

To the extent permitted by Kuwaiti law, our services are provided "as is" and "as available" without warranties of any kind, either express or implied. Cyberkov W.L.L. does not warrant that our services will be uninterrupted, error-free, or completely secure against all threats. Nothing in this clause affects your statutory rights under the Kuwait Civil Code.

Limitation of Damages

To the maximum extent permitted by the laws of the State of Kuwait, Cyberkov W.L.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services. This limitation does not exclude liability for fraud, willful misconduct, or any liability that cannot be excluded under Kuwaiti law.

Cap on Liability

In no event shall Cyberkov's total liability exceed the amount paid by you for the specific services giving rise to the claim during the twelve (12) months preceding the claim.

Indemnification

Your Indemnification

You agree to indemnify, defend, and hold harmless Cyberkov, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Defense

Cyberkov reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.

Termination

Termination by You

You may terminate your use of our services at any time by discontinuing access to our website and services. For contracted services, termination is subject to the terms of your service agreement.

Termination by Cyberkov

Cyberkov may terminate or suspend your access to our services immediately, without prior notice, for any reason including breach of these Terms, suspected fraudulent activity, or as required by law.

Effect of Termination

Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including confidentiality, intellectual property, limitation of liability, and indemnification.

Governing Law & Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait, including the Kuwait Civil Code (Decree Law No 67 of 1980), the Commercial Code (Law No 68 of 1980), the Electronic Transactions Law (Law No 20 of 2014), and all applicable CITRA regulations.

Dispute Resolution

Any disputes arising from these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation within thirty (30) days. If negotiation fails, disputes may be submitted to arbitration in accordance with the Kuwait Judicial Arbitration Law (Law No 11 of 1995), or referred to the competent courts of the State of Kuwait.

Jurisdiction

You consent to the exclusive jurisdiction of the courts of the State of Kuwait, seated in Kuwait City, for any legal proceedings arising from these Terms or your use of our services. The Arabic language version of these Terms shall prevail in the event of any discrepancy with translations.
